Terms of Service

Welcome to Houszu. These Terms of Service ("Terms") govern your use of the Houszu website, mobile apps, and all related services (the "Platform"). By creating an account or using the Platform, you agree to these Terms.

1. Eligibility

You must be at least 18 years old and legally able to enter into contracts. If you are a licensed real estate professional, you represent that your license is active and in good standing.

2. Account Registration

  • You must provide accurate and complete information when registering.
  • You are responsible for keeping your password secure and for all activity under your account.
  • One person or entity may not maintain multiple accounts without our written consent.
  • You must notify us immediately of any unauthorized use of your account.

3. Acceptable Use

You agree not to:

  • Use the Platform for any unlawful purpose or in violation of any local, state, or federal law.
  • Submit false, misleading, or fraudulent property listings or information.
  • Discriminate against any person on the basis of race, color, religion, sex, disability, familial status, or national origin, in violation of the Fair Housing Act.
  • Harvest, scrape, or collect data from the Platform without our permission.
  • Attempt to interfere with, disrupt, or compromise Platform security.
  • Impersonate another person or misrepresent your affiliation.
  • Use AI-generated content in a way that misleads or defrauds other users.

4. FSBO and Property Listings

  • You are solely responsible for the accuracy of information in your listings.
  • FSBO sellers acknowledge they are representing themselves and not acting as a licensed agent.
  • Houszu provides AI tools, document templates, and compliance guidance but does not provide legal, tax, or real estate brokerage advice.
  • Service tiers (DIY Seller, Guided Seller, Professional) offer varying levels of AI and agent support as described on the Platform.
  • The Professional tier provides access to a licensed agent for transaction support, but you remain the seller of record.

5. AI Match and Anonymous Matching

  • Our AI matching engine provides compatibility scores and recommendations based on profile data.
  • Match scores are estimates and do not guarantee outcomes.
  • Anonymous matching protects identities until mutual interest is established; you consent to this process.
  • You are under no obligation to engage with any matched party.

6. Subscriptions and Payments

  • Some features require a paid subscription. Pricing is displayed on our Pricing page.
  • Subscriptions are billed monthly or annually through Wix Payments (branded as "Base44 Payments").
  • You authorize recurring charges to your payment method until you cancel.
  • You may cancel at any time; cancellation takes effect at the end of the current billing period.
  • Refunds are handled on a case-by-case basis. Contact us to request a refund.
  • Agent Growth Fund balances are platform credits, not cash, and are subject to the terms displayed at redemption.

7. Intellectual Property

The Platform, including its design, features, AI models, content, and branding, is owned by Houszu and protected by intellectual property laws. You retain ownership of content you submit (e.g., listings, photos) and grant us a license to display and process it as needed to provide the Platform's services.

8. User-Generated Content

You are solely responsible for content you post. By posting, you represent that you have the right to do so and that it does not violate any law or third-party right. We may remove content that violates these Terms or is otherwise objectionable.

9. Third-Party Services

The Platform integrates with third-party services (Google Calendar, MLS systems, payment processors, etc.). We are not responsible for the practices or content of these services. Your use of third-party services is subject to their respective terms.

10. Disclaimers

The Platform is provided "as is" and "as available" without warranties of any kind. AI-generated insights, valuations, and recommendations are for informational purposes only and should not be relied upon as legal, financial, or professional advice. We do not guarantee the accuracy, completeness, or reliability of any content on the Platform.

11. Limitation of Liability

To the maximum extent permitted by law, Houszu shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, arising from your use of the Platform. Our total liability shall not exceed the amount you paid us in the preceding 12 months.

12. Indemnification

You agree to indemnify and hold Houszu harmless from claims, damages, and expenses arising from your use of the Platform, your content, or your violation of these Terms.

13. Termination

We may suspend or terminate your account at any time for violation of these Terms. You may close your account at any time. Upon termination, your right to use the Platform ceases immediately.

14. Governing Law

These Terms are governed by the laws of the State of Texas, without regard to conflict of law principles. Any disputes shall be resolved in the courts located in Texas.

15. Changes to These Terms

We may modify these Terms at any time. Material changes will be notified via email or in-app notification. Continued use after changes constitutes acceptance.
